Dear Comrade,

               You must have read from the Newspaper that the Government has extended the time limit for the 7^th CPC to submit its report by four months. The Commission might therefore submit its report by 31^st December, 2015.  No discussion on the report, if submitted on 31.12.2015 would be held in the quarter ended on 31.3.2016 as the Government officials would be busy with the budget session of the Parliament.  However, the reports emanating from the Commission indicate that the Chairman wanted the report to be given to the Government by 30^th September, 2015.  Due to this uncertainty, the meeting we had planned to convene in October, 2015 of the National Sectt. Of the ITPF was postponed, as the main agenda was discussion on the recommendations of the 7^th CPC. We must in any case hold the said meeting as and when the report is made available and formulates our stand on pension related matters. 

               Another development is that the Government after a lot of dilly dallying has now decided to concede the demand for one rank one pension to the Defence Personnel with revision every five years.  The reason for the procrastination on the part of the Government was the probable impact the decision would bring about on the civilian pension.  The Government has, it seems, now come to the conclusion that the public sentiments that might generate on the denial of one rank one pension would be very great whereas it would be insignificant in the case of civilian employees.  Before the 7^th CPC one of the most important issues we have raised is the need to bring about parity between the past and present pensioners  and have demanded that the formulation made by the 5^th CPC in the matter must be carried forward to be applicable to all pensioners who have become so after 1.1.1986.  The modified parity which has been implemented would not in any way benefit persons who had stagnated in a cadre for years while in service.  We send herewith a copy of the letter written by the Staff Side secretary, JCM National Council, Com. Shiv Gopal Mishra in the matter.  We would further request our members to once again go through the memorandum we have submitted to the 7^th CPC especially the chapter dealing with the question of parity.  Even if the parity is brought about, it would not be anywhere equal to the dispensation made by the Government to the Defence Personnel. i.e. one rank one pension with  in built revision of every five years. 

               During the interregnum period between the National convention at Haridwar and to-date, the Mumbai and Delhi Units have informed of certain activities.  The Mumbai unit has taken certain concrete steps to form the I.T. Pensioners Association.  Adhoc committee has already been formed.  The Delhi Unit had its annual General meeting on 3^rd September, 2015.  The Karnataka Unit has convened its annual general body meeting at Bangalore in the next month.  We have appended a brief report of the Delhi and Mumbai meetings for your information.

               In our Haridwar Convention, we had taken a decision to collect the information regarding the pending disciplinary proceedings against our members.  We shall be grateful if the State Units will kindly collect the requisite information and forward the same to us, so that we can compile the same and take up the matter for an expeditious disposal with the authorities

                              Sub: Parity between past and future pensioners.

               While urging for parity in pension, for past and future pensioners before the Seventh Central Pay Commission, Staff Side, National Council/JCM vide Chapter IV Para 4.1. Submitted as follows:-

“The Government have recently announced that one Pension shall  be implemented in respect of Armed Forces so that the glaring disparity between the persons of equivalent rank and status do not draw vastly unequal pensions if they retire at different point of time is undone.  Already there is a complete parity in pension among the Judges of Supreme Court, High Court and the Comptroller and Auditor General of India, irrespective of the date of their retirement”.  Now the Government of India has accepted the demand for one rank one pension in respect of Armed forces.

The detailed justification fo the same has already been submitted in our aforesaid memorandum, as well as during our oral evidence before the Central Pay Commission.

The Civilian employees of Central Government have been waiting anxiously for implementation of the same equally for them and hope that the Seventh Central Pay Commission would administer justice by recommending “One rank one pension to all other past and future pensioners irrespective of their date of retirement and remove the injustice done to them so long.

Activities at Mumbai.

               The comrades who attended the National Convention at Haridwar of the Income tax Pensioners Federation from Mumbai took the initiative to form a composite Association of Pensioners of Income tax Deparment  at Mumbai.  They invited about 35 comrades, who were active in both the ITEF and the ITGOA while in service.  28 Comrades could attend the meeting.  The rest seven comrades, while welcoming the move and extending their full support to the effort expressed their inability to attend the3 meeting due to their being out of Mumbai.  The meeting , though  a very small gathering,  expressed the need for such an organization in view of the  great amount of difficulties faced by the  pensioners  in resolving some of the unsettled issues.  Com. V.K. Sreedharan, former Secretary General ITGOA narrated the proceedings of the meeting at Hardwar and informed the gathering that barring one or two States, almost all States had sent in their representatives to attend the National Convention.  He said that the organisation at the apex level would be a Federation and each State is supposed to form a State association with specific constitution, bye laws and rules.  He also informed the members the need for getting the Association registered before the Registrar of Societies and the need for drafting the constitution to attune to the provisions of the Societies Act of each State.  Com. KKN. Kutty attended the meeting  and apprised the members of the crux of the demands placed by the Staff Side of the JCM. National Council before the 7^th CPC.  He said that though the memorandum  was exhaustive, reasoning out the demands clearly, given the attitude of the Government, many of the genuine issues might not be getting a favorable response from the Government.  The Commission, though headed by a Justice of the Supreme Court is loaded with bureaucrats who are duty bound to abide by the directive of the Finance Ministry.  With all the debilities, he pleaded that the Pensioners must be optimistic as has been shown by the Defence Service personnel raising their demand for one rank one pension.  The comrades who assembled raised various queries, which was replied by Com. Kutty.   The meeting decided to form an adhoc committee with Com. V.K. Sreedharan as Chairman and Com. Ashok Salunkhe as the Convenor.  They will work out modalities for enrolling members and holding a State convention by  February, 2016.   The meeting also formed a legal committee to draft a suitable constitution for the association taking into account the various provisions of the Maharashtra State Societies Act.   The ITEF comrades rendered all help and assistance in the conduct of the meeting as the same was held in the shamiana at the Income tax premises (Aayakar Bhawan) Mumbai. 

Annual General meeting at Delhi.

               The first AGM of Delhi I.T. Retired Persons welfare Association was held at Delh9i (Conference fall, Income tax Office, Civic Centre, D. Block) on 3.9.2015. Com. Lajpat Rai, President of the Association, presided over the function.  The Chief Guest on the occasion was Shri Sudhir Chandra, former Chairman, Central Board of Direct Taxes.  Other Guests of honour were Shri P.J. Thomas, former Chairman, CVC  and former Chief Secretarfy, Kerala, Com. Shiv Gopal Mishra, General Secrfertaqry, AIRF and Secretary, Staff Side, National Council, JCM, Com. K.K.N. Kutty, President Confederation of CGE and workers, General Secretary, Incometax Pensioners Federation.  Com. Ashok Kanojia, President, ITEF, CHQ. and Shri M>M. Kapoor of BPS greeted the meeting.  The AGM was well attendedand the hall was packed to the brim. Com. Lajpat Rai in his presidential address touched upo:

(a)    Expansion of membership

(b)    Corpus fund

(c)    Facility of room and guest house

(d)    Excursion tour within India and abroad;

(e)    CGHS related problems

`              Com. Baswanad, General Secretary  gave a report of the Assoiciation’s acitiviites of the last one year and Com. Aggarwal presented the account.  Com. Shiv Gopal Misra enlightened the members of various pensioners’demands placed before the 7^th CPC by the Staff Side.  Com. Kutty detailed the efforts undertaken to form the ITPF and its first convention at Haridwar. Shri P.C. Thomas addressed the house and greeted the members.   Later, the members who have crossed the age of 80 years were honoured. 

               To conclude the AGM in a hilarious manner, a hasya kavi sammelan was organized in which two renowed artists participated i.e. S/Shri Aggravanshi and Deepak Gupta.  It was announced that the next AGM will be held on 17^th December, 2015  to observe Pensioners ‘day

.

Dear Comrades,

I have the proud privilege and pleasure to inform you of the successful conduct of the first and founding Convention of the Income tax Pensioners Federation at Haridwar on 4.06.2015 as scheduled.  The Income tax Pensioners Association, Meerut had taken the strenuous responsibility of holding the first convention.   They had made excellent arrangements for the comfortable stay of the comrades, despite the hot weather condition, Haridwar being at the peak of the summer.  In fact the showers on 3^rd had lowered the intensity of the heat wave.   It must be admitted without hesitation that the food provided was of a very excellent quality.  The comrades of Meerut had made the stay of each of the delegates highly comfortable. Most of the delegates had reached the venue on 3^rd itself. 

In all there were 52 delegates and observers who attended the meeting, besides the observers and volunteers from the host association.  They represented the following States.

5.       Gujarath

6.       Rajasthan

7.       Madhya Pradesh

8.       North West Region

9.       Uttar Pradesh West

15.   Kerala had informed of their inability to attend but had sent in a written message.

16.   Nobody came to represent Vidharba, Orissa and Pune regions.

We are hopeful that the States which could not send in their representatives would be able to attend the next meeting.

The Convention was conducted by a Presidium consisting of the following comrades:

We had invited the President and Secretary General of ITEF and ITGOA to greet the convention.  On behalf of ITEF Com.Ashok Kanojia , President addressed and greeted the delegates. He assured the fullest co-operation from ITEF for the well functioning of ITPF. Com. Bhaskar Bhattacharya, Secretary General, ITGOA intimated his inability to be present at Haridwar due to a sudden engagement the ITGOA had with the Cabinet Secretary.  The convention was also greeted by Com. N.C.Upadhyaya, Dy. Commissioner of Income tax, Haridwar on behalf of the staff and officers of Haridwar, and  Com.B.N. Singh, Retired Chief Commissioner of Income tax, Kanpur. The Staff and officers of Haridwar had extended full co-operation for the conduct of the convention and many of them were present at the inaugural session.

The Convention commenced with the traditional lighting of the lamp and welcome address by Com.S.K. Sharma,  on behalf of the host unit.  Comrades in the presidium solicited approval of the agenda for the convention. The agenda as per the notice issued was as under:

1.       Discussion on the proposed draft constitution of ITPF.

2.       Election of office bearers

3.       Discussions on issues pertaining to Income tax pensioners.

4.       Any other matter with the permission of the chair. 

The house approved the agenda.

Agenda Item No.1.

The Presidium then requested the convenor to present the proposal over the draft constitution, bye-laws and rules. Com.KKN.Kutty detailed the efforts taken to draft the constitution and the proceedings of the preparatory committee meeting held at Mumbai.   He explained the circumstances under which the Preparatory committee decided to switch over the ITPF set up from the proposed unitary structure to a federal one.  He applauded the efforts made by the Karnataka Income tax Pensioners Association  under the leadership of Com. O.M.Baskaran and Com. R.B.Deshpande in redrafting the constitution, bye-laws and rules in consonance with the provisions of the Societies Act, the registration of which will make the Federation  a legal entity.  He also explained the basis of the suggestion made to expand the team of office bearers so as to include a representative from each Charge as in many States the primary unit is yet to be set up. The meeting then witnessed a lively discussion in which the delegates participated and made the following suggestions.

(a)    To have a patron to enable the organization to function effectively. Shri Sudhir Chandra former Chairman, CBDT would be requested to be the Patron of the ITPF.

(b)   To have an Advisor to help the Office bearers to function properly. Com Lajpat Rai would be requested to kindly be the Advisor in view of the vast experience he has as the Secretary General ITGOA and many positions in ITEF and the Joint Convenor of Central JCA and a leader of the Incometax Pensioners Associations at Rajasthan and Delhi.

(c)    To increase the number of Vice Presidents to six.

(d) To replace the two posts of Joint Secretaries with one Additional Secretary to have cohesiveness in the functioning of office bearers.

(e)   To have One Organizational Secretary from each of the 18 charges.

(f)     To raise the Number of Assistant Secretaries to 6.

(g)    To have an Auditor to be appointed by the Central Working Committee.

(h)   To read Artcile 14 (a) as under:The working committee shall meet once in a year to consider the following.

(i)     Artticle 4(vi) add the word “health” after the word “education”’

The Convenor said that the draft of the constitution, bye laws and rules were on the website for a long time and the drafting Committee had taken into account every suggestion received by it.  The Presidium then placed the draft along with the above amendments for the considerations of the house.  The house adopted the constitution, bye laws and rules unanimously.

Agenda ItemNo. 3.

Problems and issues:

Com. Kutty explained the various issues taken up by the NCCPA  and staff side JCM National Council before the  7thCPC.  He also explained as to how the question of parity between the past and present pensioners in pension entitlement has assumed significance in the background of the Government accepting the demand for one rank one pension for defense personnel.  In the discussions that ensued thereafter, delegates raised the issues concerning CGHS, fixed medical allowance, conveyance charges and the inordinate delay in settling disciplinary proceedings etc. The meeting decided to elicit information about the problems from all pensioners and to present the same as a charter to the next CWC  for discussion and further follow up action.

               

In conclusion, the meeting placed on  record the excellent work done by the drafting committee of the constitution.  The meeting asked the Secretary General to write to the Secretary General ITEF for providing some space for the functioning of the ITPF office at Delhi.  On behalf of the Presidium, Com.Shanthi Kumar praised the host unit for the excellent arrangements made by them. Com.Deshpande and Com.Umesh Mehta, both expressed their appreciation over the efforts in the formation of ITPF and stressed the need of strengthening the organization. Many of the delegates expressed the view that the host unit must collect some amount as delegate fees to meet out a portion of the expenses.  However, on behalf of the host unit, Com. S.K.Sharma said that he was aware that many delegates have come to attend the convention at their personal expenses and the host unit and reception committee would not like to burden them further. Even then some of the delegates contributed and the same was taken as donation to ITPF CHQ. The delegates who spoke at the convention, all appreciated the efforts made to form ITPF and said that whenever they had  convened the meeting of pensioners in their respective States, they have received enthusiastic response.  All of them assured the house of the renewed efforts to form Associations in their States, adopt Constitution rules etc. in consonance with the provisions of the Societies Act and make ITPF as strong, united and militant. Com. Convenor requested the Karnataka/ Delhi Unit to provide the copy of their constitutions to the other States as a model as both the Associations have obtained registration from the Registrar or Societies. The Presidium expressed the confidence that with the rich experience of many of the delegates as Trade Union Activists and leaders, ITPF will grow from strength to strength and would become a potent organization in future to ensure that no IT Pensioner will suffer any difficulties.  Com. C.M Badola announced the receipt of Rs. 23,000 as donation from the delegates and others. Com.R.K. Bhatnagar  President of the host Unit proposed the vote of thanks and the meeting was concluded at 3.45PM

            This is further to the SMS I had sent you a few months back and the letter placed on Our Website. The host unit for holding the first convention ie. The Incometax Pensioners Association, Meerut has informed us of the steps they have taken to hold the convention.  As you are aware, this being the first convention and the all India Body is yet to take its shape we are financially constrained to hold a large scale convention.  Moreover, as you are aware in many States steps are yet to be taken to form associations.  In some States the pensioners belonging to our organization are already members of the Central Government Pensioners association.  Since many of them are functioning excellently well, they have some reluctance, which is understandable.  As informed in our earlier communication,  arrangements have been made for boarding and lodging at Haridwar on 3^rd evening onwards and would be available upto 10.30 AM on 5^th.  We place hereunder the formal notice with agenda for discussion at the convention.

                                I have sent you the following SMS.

“All India convention of IT Pensioners Fedn. at Haridwar on 4^th June, 2015. Please attend. Details and notice on website”

As you are aware, we have been trying to organize and All India body for the Income tax Pensioners for some time now.  Quite a number of our retired comrades are in various organizations.  As has been made clear at the preparatory committee meeting, we do not intend to disturb the said arrangements.  The  organizations of employees retiring from each department separately was thought by the Confederation and NCCPA as the best means of organizing  large majority of them.  We are fully aware that the pensioners constitute one class, especially when the pay master happens to be the Government of India.  We have to function unitedly  in order to ensure that our voice is heard. 

During the hearing before the 7^th CPC,  the Staff had deployed the undersigned to present the memorandum.  One of the issues that came up for discussion was the retirement benefit.  The Commission was categorical that they could not do anything with the New Pension Scheme  as it has become now an Act of Parliament.  Presently about 20-25% of the serving employees are covered by the New Pension scheme.  There is going to be a long drawn out struggle.  The existing benefit enjoyed by the Pensioners may not last in the situation that is getting created.   In the given situation effecting improvement over the pension viz. the parity question, the discrimination in the matter of health care, the meager amount of allowance for outpatient treatment, the scores of problems with the CGHS, the computation of pension itself, are not going to be easy. 

Our attempt as mentioned in the preceding paragraph  is to unite and bring into the organizational  forum more and more number of retired personnel. 

We have drafted a constitution on the basis of the discussions we had at Mumbai in the preparatory committee meeting.  In a few places, the I.T. Pensioners are already working.  In other places, we have to make attempt to organize them.  Wherever it is in existence, we have tried to ascertain the office bearers of the organization  and invite them to participate in the convention.  We are ascertaining further as to who are the office bearers and would invite them to the convention.

The main agenda for the convention is to further deliberate upon the provisions of the Constitution and adopt the same so that the organization ITPF can come into existence formally.  The following agenda is proposed.

(a)    Adoption of the Constitution.

(b)   Discussion on the pension benefits in general and the submissions before the 7thCPC.

(c)    Organizational set up at the CHQ and at the state levels.

(d)   Election of office bearers.

(e)   Any other issues of importance with the permission of the Chair.

You may kindly go through the agenda and suggest additions/alterations etc.  We propose to issue the formal notice by the end  of this month.

CONSTITUTION OF THE

INCOME-TAX PE SIONERS FEDERATION.

MEMORANDUM OF ASSOCIATION

1.       Name: The name of the Association shall be the “Income-tax Pensioners’ Federation” hereinafter referred to as ITPF

2.      Headquarters:  The headquarters of the ITPF shall be at New Delhi.

3.       JURISDICTION:  The jurisdiction of the ITPF extends to whole of India.  Any dispute arising from the action taken in consonance with the provisions of this constitution shall, therefore, only be under the jurisdiction of the Courts of law situated in New Delhi.

4.       Aims and objects:  The aims and objects shall be:-

i)                    To organize the pensioners of Income-tax Department and formation of Pensioners’ Associations.

ii)                  To secure, protect, promote and safeguard the interests and rights of the Income-tax Pensioners and Family Pensioners and to take such measures as may be necessary to achieve the objectives.

iii)                 To take such measures as considered necessary to ensure speedy implementation of orders of the Central Govt. or of judicial decrees under which relief to pensioners is given.

iv)                To affiliate with National Co-ordination Committee of Pensioners’ Associations.

v)                   To work in co-ordination with organizations having similar objectives for the wellbeing of the members of the ITPF.

vi)                Promotion of education, literature, fine arts, charity and sports among members of affiliated Associations and their families.

vii)              To co-ordinate and guide the activities of the affiliated Associations.

viii)            To do all such things as are incidental to or conducive to the attainment of the aims and objects mentioned above.

NOTE: 1. All the income, earnins, moveable, immovable properties of the ITPF shall be solely utilized and applied towards the promotion of its aims and objects set forth in the memorandum of association and no profit thereof shall be paid or transferred directly or indirectly by way of dividends, bonus, profits or in any manner whatsoever to the present or past member s of the ITPF or to any person claiming  through any one or more of the present and past members.

Note 2: No member of the Federation shall have any personal claim on any moveable or immovable properties of the ITPF  or make any profit,   whatsoever by virtue of its membership.

CONSTITUTION OF THE

INCOME-TAX PE SIONERS FEDERATION.

RULES AND REGULATIONS

1.       Name: The name of the Association shall be the “Income-tax Pensioners’ Federation” hereinafter referred to as ITPF.

2.       Headquarters:  The headquarters of the ITPF shall be at ……………………………………., New Delhi.

3.        JURISDICTION:  The jurisdiction of the Federation extends to the whole of India.  Any dispute arising from the action taken in consonance with the provisions of this constitution shall, therefore, only be under the jurisdiction of the Courts of law situated in New Delhi.

4.       Membership: Any Association/Union of the Pensioners of the Income-tax Departmentf shall be eligible to become a member ITPF provided it agrees to abide by the rules and regulations of  ITPF. The Associations/Unions , which are so admitted as members will abide by the decisions taken by the ITPF.

5.       ADMISSION. Any Association/Union of pensioners of Income-tax Department desirous of becoming a member shall make an application in writing to the Secretary General, ITPF together with affiliation fee of Rs.1000/- (Rupees one thousand only) along with a copy of its memorandum of Association and Rules and Regulations or Bye laws as the case may be together with latest annual report and audited statements of accounts if any, giving the number of its members.  The Secretariat will be competent to admit such Association/Union as a member of ITPF.

6.       FORFEITURE OF MEMBERSHIP:

(a)    Any affiliated member Association/Union may be disqualified of its membership of the ITPF if it is in default of subscription for more than one year or it is working against the interest of the ITPF.  The disqualification is done by the Working Committee after affording an opportunity of being heard to such Association/Union by the Secretariat

(b)   Such membership may be restored on payment of all dues subject to the approval of the Secretariat.

7.       SUBSCRIPTION:  All affiliated Association/Union shall pay an annual Subscription to the ITPF  as follows:

a)      Membership up to 500                                          Rs.2000  p.a.

b)      Membership above 500  and upto 1000          Rs.3000 p.a.

c)       Membership above 1000 and upto 2000        Rs.4000 p.a.

d)      Membership above 2000                                     Rs.5000 p.a.

8.       ORGANISATION AND MANAGEMENT:  For the management, administration and governance of the ITPF there shall be  

i)                    Delegates Conference;

ii)                  Working Committee and.

iii)                Secretariat

9.       DELEGTATES CONFERENCE

a) The Delegates conference shall be the supreme body of the ITPF consisting of the Secretariat; working committee members and delegates authorized by the affiliated units.  The Association/Unions may send one delegate for every 100 members or part thereof subject to a minimum of one delegate for each affiliated unit.

b)      The conference shall ordinarily meet once in three years at a convenient place and time  

i)        To consider and adopt the report of the Secretary General and audited statement of accounts approved by the Working Committee

j)        To elect Office bearers.

k)      To consider matter as may be referred to by the working committee.

l)        To amend  the constitution

m)    To pass resolutions

n)      To consider the budget estimates

o)      To appoint auditor.

p)      To consider any other matter  for which notice is given.

10.   Special Delegates Conference:  A Special conference may be convened

a)      on the recommendation of the Working Committee

b)       On a requisition made by not less than two third of the affiliates.

c)       On the directions of the Registrar

11.   Notice.:    The notice for the Delegates conference shall be given at least 45 days in advance and Special Conference 30 days.

12.   Quorum:  The quorum for conference and special conference shall be one third of the total number of affiliates.  In the event of quorum being not available within 30 minutes of the scheduled time of the meeting, the meeting shall be adjourned for 30 minutes.  If there is still no quorum the adjourned meeting can proceed with the members present and transact business notified in the agenda.

13.   Voting Power: Voting power of each affiliated unit shall be on the basis of one vote for every hundred members of part thereof subject to a minimum of one vote for each affiliated unit.  Every delegate who is present in the conference shall have one vote.  The President of the Conference shall have the casting vote.

14.    WORKING COMMITTEE: The Working Committee shall consist of Members of the Secretariat and Secretary/ General Secretary of the affiliated units or any other office bearer nominated by the affiliated association/union. 

(a)    The Working Committee shall meet once in a year to consider the following.

(i)                 To consider annual report of the Secretary General

(ii)               To consider and approve audited accounts

(iii)             To consider resolutions

(iv)              To consider any other matter with the permission of the chair.

Note:  Decision in the Working Committee is on the basis of views expressed by majority of the members present in the meeting.

15.   SECRETARIAT: The Secretariat shall consists of the following: -

1.       The President

2.       Two Vice Presidents

3.       Secretary General

4.       Two Joint Secretaries

5.       Finance Secretary and

6.       Four Assistant Secretaries who shall be nominated by the President in consultation with and the consent of the Secretary General.

Explanation:  

a. The Members of the Secretariat shall enjoy the primary membership of their respective affiliated units.

b. All the members of the Secretariat other than Assistant Secretaries shall be elected by the Delegates Conference with their consent to be expressed in writing though they may not be physically present in the conference.

c.       The Assistant Secretaries shall be nominated by the President in consultation with and consent of the Secretary General.  The person so nominated as Assistant Secretary shall be a primary member of the affiliated Association/Union. The President shall consult with the General Secretary/Secretary of the affiliated Association/union in which he is a primary member before such nomination is made.

d.      Term of office of the Secretariat shall be three years.  They are eligible to be re-elected in the delegates conference.

e.      Filling up of vacancies in the Secretariat:  The vacancies in the secretariat shall be filled up by President after getting approval of the Secretariat and the working committee. 

16.   POWERS AND FUNCTIONS.

a.       President: President shall preside over all meetings of the Secretariat, Working committee and Delegates Conference.  In all matters of procedure, the ruling given by the President shall be final. He shall have the casting vote.

b.      Vice Presidents:  Vice Presidents shall assist the President.  In the absence of the President, one of the Vice Presidents shall preside over the meetings.

c.       Secretary General:  Secretary General shall the Chief Executive of the ITPF.  He shall carry out the mandate of the Conference, the Working Committee and the Secretariat.  He shall conduct all correspondence and make representation with the authorities concerned.  He will prepare the annual report to Working Committee and Conference   He shall maintain all records, convene the meeting of the Secretariat, working committee and the conference and do such other things as may be necessary from time to time.  Between the meetings he will act on matters of vital importance on the basis of the views of the  majority of the members of the Secretariat.   He shall be the joint signatory with Finance Secretary for operating the Bank accounts. He shall be allowed an impress Cash of Rs.5000/- (Rupees five thousand only) and shall render accounts for the same to the Finance Secretary.  He will also have powers to incur expenses of recurring nature.

d.      Joint Secretaries:  The joint Secretaries shall assist the Secretary General on day to day functioning of the ITPF.  In the absence of the Secretary General, one of the Joint Secretary  shall function as the Secretary General of the Federation.

e.      Finance Secretary:  Finance secretary shall be responsible for the maintenance of accounts and will be responsible to the working committee for rendering proper accounts of the monies vested with him.  He shall operate the Bank accounts along with the Secretary General. He shall keep an impressed cash of Rs.5000/- with the Secretary General.  He shall render audited accounts to the meeting of the working Committee and the Conference. 

f.        Assistant Secretaries:  The Assistant Secretaries shall function under the guidance of the Secretary General. 

17.   Accounting year:  The accounting year of the ITPF  shall be the financial year i.e. from 1^st of April to 31^stof March and the account shall be audited each year by the auditor nominated in the Delegates Conference.  

18.   Funds:  Funds of the ITPF consists of affiliation fees and subscription from affiliated units.  In addition the Federation may also receive donations and grants and collection by circulation of periodicals . The  Funds of the Federation shall be deposited either in a Scheduled Bank in the name of the ITPF  and shall be operated jointly by the  Secretary General and the Finance Secretary. 

19.   Audit of accounts:  The accounts of the federation shall be audited and presented to the delegate conference after its approval in the Working committee.

20.   Election.   Election to the members of the Secretariat other than Assistant Secretaries shall be held triennially.  The entire process of election viz. calling for nomination, withdrawals, declaration of names of eligible candidate and the actual election if there be a contest shall be commenced and completed at the conference of the ITPF itself. 

21.   Affiliation: The ITPF shall be affiliated with the National Co-ordination Committee of Pensioners Associations.  It may seek affiliation with any other all India organization of pensioners or world body of pensioners/retired personnel, if decided by the Working Committee.

22.   Amendment:  The amendment to the Constitution (Memorandum of association and rules and regulations) shall be made in the Delegates/Special Delegates Conference only if two third of the delegates present at the conference votes in favour of such amendments

23.   Dissolution:   Dissolution of the ITPF can be decided upon by a Special Delegates Conference called for the purpose after giving one months notice.  The ITPF can be dissolved only if three fifth of the  affiliates present in the conference approves the dissolution. 

24.   Registration:  The ITPF shall be registered with the Registrar of Societies in India at New Delhi and will abide by its rules and regulations.

25.   Notwithstanding anything ibid, the provisions of Societies Registration Act 1860 shall be applicable.
